AG responds in lawsuit against Childers
Missouri Attorney General Andrew Bailey has filed a new response in an ongoing legal dispute with Sheriff Scott Childers in Ray County Court. On March 7, Childers was removed from office under criminal investigation and is on paid administrative leave. This comes at the hands of Missouri Attorney General Bailey via petition of quo warranto. Quo warranto is a common law remedy used to challenge a person’s right to hold a public office In the response, Bailey claims Childers has no legal grounds to amend the defenses he previously filed.
Bailey and Bruce are referred to as the “realtor” and Childers the “respondent” in the following excerpts.
“Respondent must seek leave of this court to file an amended answer; he has no right to do so. Rule 55.33(a); Saint Luke’s Hosp.
