Ray County courts overruled Sheriff Scott Childers’ motion to dismiss the State Attorney General’s quo warranto, a challenge to a person’s right to hold a public office. Childers’ three-day trial will begin at 9 a.m. Sept. 9. Childers appeared before 43rd Judicial Circuit Judge Daren L. Adkins Tuesday, arguing through his private attorneys, Kevin R. Corlew and Lydia E. McEvoy, that the standards for a quo warranto have not been met. “The petition failed to sufficiently state a claim,” said Corlew. “The allegations made in the petition state no facts with dates, names or documents.” The Missouri Attorney General’s office contended there was reason for the absence of specifics. “There are no names, dates, or documents because of a discovery issue,” stated Assistant Attorney General Theodore Bruce. “If the petition is believed to be factual, then does he still feel there are grounds for dismissal,” Judge Adkins asked. “If all information is believed to be true, the statute for the…
